1. Agreement to Terms

By purchasing, installing, or using PodEmbed (“the Service”), you agree to be bound by these Terms of Service. PodEmbed is operated by Epic Creative Group, LLC, doing business as Tell Studios. If you do not agree to these terms, do not purchase or use PodEmbed.

3. Product Description

PodEmbed is a fully hosted embeddable podcast player. Upon purchase, you receive:

A software license key that activates the player
Access to the configurator tool to customize your player
An embeddable script tag for your website

PodEmbed reads publicly available podcast RSS feeds. It does not host, store, or redistribute your podcast content.

4. License Grant

Your purchase grants you a non-exclusive, non-transferable license to use PodEmbed, subject to the following:

Each license key is valid for use on one website
You may modify the source code for your own use
You may not redistribute, resell, sublicense, or share PodEmbed or its source code
You may not share your license key with third parties
Your license remains valid as long as these terms are not violated

5. Pricing and Payment

Core plan: $49 one-time purchase
AI tier (Monthly): $12/month plus a $49 one-time setup fee
AI tier (Annual): $99/year plus a $49 one-time setup fee

All payments are processed by LemonSqueezy, which acts as Merchant of Record and handles sales tax, VAT, and billing.

We reserve the right to modify pricing, features, or availability of the Service at any time. Any pricing changes will not affect existing paid subscriptions until their next billing cycle, unless otherwise stated. Continued use of the Service after pricing changes constitutes acceptance of the new pricing.

6. AI Tier — Additional Terms

The AI tier provides episode transcription and AI-generated summaries powered by third-party services (Deepgram for transcription, Anthropic for summaries). By using AI features, you acknowledge:

AI features depend on third-party APIs and may experience downtime or changes outside our control
AI-generated transcripts and summaries may contain inaccuracies
Epic Creative Group, LLC is not responsible for the output or availability of third-party AI services
If you cancel your AI subscription, your Core license and existing transcripts remain accessible, but no new transcriptions can be generated

7. Service Availability

We do not guarantee uninterrupted or error-free operation of the Service. The Service is provided “as is” and “as available.” We may modify, suspend, or discontinue any part of the Service at any time without prior notice. Scheduled maintenance and third-party service disruptions (including our hosting infrastructure, Deepgram, and Anthropic) are outside our control.

8. Refund Policy

PodEmbed is a digital product delivered immediately upon purchase. All sales are final as a general policy.

If you experience a technical issue that prevents the product from functioning as described, contact support@tellstudios.com within 14 days of purchase. We will work to resolve the issue or, at our discretion, issue a refund.

AI tier subscriptions may be cancelled at any time. No refunds are issued for partial billing periods.

9. Acceptable Use

You agree not to:

Use PodEmbed for any unlawful purpose
Attempt to circumvent the license validation system
Share your license key or use it across multiple unrelated websites
Remove or alter any PodEmbed attribution if present

10. Intellectual Property

The PodEmbed source code, design, name, and brand are the property of Epic Creative Group, LLC. Your purchase grants a license to use the product, not ownership of it.

Your podcast content remains entirely your own. PodEmbed does not claim any rights to your content. RSS feeds are publicly accessible data; PodEmbed reads but does not store or modify them.

11. Limitation of Liability

PodEmbed is provided “as is” without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by law, Epic Creative Group, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, revenue, or business opportunities.

In no event shall Epic Creative Group, LLC’s total liability exceed the amount paid by you for the Service in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Epic Creative Group, LLC, its officers, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorney’s fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

13. Changes to Terms

We may update these terms from time to time. Continued use of PodEmbed after changes are posted constitutes acceptance of the revised terms. Material changes will be communicated via email to license holders.
